California Computer Professional Exemption Attorney

If I work in computers, how do I know if I deserve to be paid overtime?

Under the labor laws of California, computer professionals can only be exempt from overtime pay if they are paid more than $47.81 an hour (as of January 1, 2006). In addition to the rate of pay, the type of work done must be actual programming, design, development, or creation of programs and require a high level of skill. Employees who simply install software, run a help desk, or perform maintenance would not be exempt and must be paid overtime according to California wage guidelines:

Overtime must be paid for any time worked over 8 hours in a day or 40 hours in a week, at 1 ½ times the employee’s regular rate. Any work over 12 hours per day must be compensated as double time.

Even if a programmer or salesperson is compensated on a piece-rate or commission basis, they are entitled to overtime.
